General Terms and Conditions of IconicHome.com
§ 1 General
ICONIC HOME is an EU registered word/figurative mark of Designscape Creative GmbH. IconicHome.com is an online store for designer vases of Designscape Creative GmbH.
Designscape Creative GmbH, Kreuzstr. 19-23, 66589 Merchweiler (hereinafter referred to as ICONIC HOME ) offers goods, in particular 3D printed designer vases, for sale via the IconicHome.com website.
§2 Begriffsdefinitionen
(1) The following General Terms and Conditions apply to all deliveries between ICONIC HOME and a consumer in the version valid at the time of the order.
(2) A consumer within the meaning of these Terms and Conditions is any natural person who concludes a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.
§3 Conclusion of a contract, storage of the contract text
(1) The following provisions on the conclusion of a contract apply to orders placed via our online shop https://iconichome.com .

(3) The presentation of the goods in our Internet store does not constitute a legally binding contractual offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online store, the following provisions shall apply: The consumer submits a binding contractual offer by successfully completing the order procedure provided in our online store.
The order is placed in the following steps:
1) Selection of the desired goods
2) Confirmation by clicking the "Add to shopping cart"
3) Checking the information in the shopping cart
4) Pressing the "Checkout"
5) Logging in or registering in the online shop.
6) Checking or correcting the respective data again.
6) Re-checking or correcting the respective data entered.
7) Binding submission of the order.
The consumer can correct their entries before the binding submission of the order or cancel the order process by closing the Internet browser. We confirm receipt of the order immediately by means of an automatically generated e-mail ("order confirmation"). With this we accept your offer.
(5) Storage of the contract text for orders via our Internet store : We save the contract text and send you the order data and our GTC by e-mail. You can also view the GTC at any time athttps://iconichome.com/agbYou can view your past orders in our customer area under My user account -> My orders.

§4 Prices, shipping costs, payment, due date
(1) The prices quoted include statutory VAT and other price components. Any shipping costs are added.
(2) The consumer has the following payment options:
- (1) Purchase on account
In the case of purchase on account, the invoice amount is due for payment to our external partner Klarna on the calendar day specified in the invoice (14 calendar days after the invoice date). The payment method purchase on account is available for private customers from Germany and Austria and requires, among other things, a successful credit check by Klarna GmbH. If the customer is permitted to purchase on account for certain offers after a credit check, the payment is processed in cooperation with Klarna GmbH, to whom we assign our payment claim. In this case, the customer can only make payment to Klarna GmbH with debt-discharging effect. We remain responsible for general customer inquiries even when purchasing on account via Klarna (z.B. to the goods, delivery time, shipment), returns, complaints, revocation declarations and returns or credit notes. The General Terms and Conditions of Klarna GmbH shall apply.

(3) If the consumer has chosen to pay in advance, he undertakes to pay the purchase price immediately after conclusion of the contract.
§5 Delivery
(1) Unless we have clearly stated otherwise in the product description, all items offered by us are ready for dispatch within 1-7 working days. The vases offered at ICONIC HOME are made to order for you using the 3D printing process after receipt of your order.
(2) If the consumer has chosen payment in advance, we will not ship the goods before receipt of payment.
§6 Retention of title
We reserve title to the goods until the purchase price has been paid in full.
§ 7 Right of withdrawal
Consumers have the following right of withdrawal

You have the right to withdraw from this contract within 30 days without giving any reason. The withdrawal period is 30 days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise the right to cancel, you must inform us (Designscape Creative GmbH, Kreuzstr. 23, 66589 Merchweiler, Email:info@iconichome.com , Tel: (+49) (0) 6825/4049264) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.
To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent back the goods, whichever is the earliest
You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.
The right of withdrawal does not apply to the following contracts:
Contracts for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

§8 Reklamationen
We will replace your product if it is faulty or has been delivered incorrectly. In the event of a justified complaint, the postage costs incurred will be reimbursed by ICONIC HOME .
§9 Processing and quality
The designer vases are made from PLA using a 3D printing process based on renewable raw materials. We expressly point out that the vases are only suitable for indoor use. They must not be exposed to temperatures above 40°C. They must also not be exposed to direct sunlight. There is a risk of deformation due to high temperatures or strong sunlight. Due to the 3D printing process, each vase is unique. Small grooves and irregularities are typical for this type of production and do not constitute a defect. A legally binding assurance of certain properties cannot be derived from our specifications. The colors shown are approximate values and may differ slightly from the screen image. All goods from our store are subject to statutory warranty rights.
§10 Haftungsbegrenzung
The designer vases printed from PLA are intended for use with dried flowers. They are not waterproof. When using with fresh flowers, use the polypropylene (PP) insert supplied. The recyclable PP insert is also manufactured using the 3D printing process. It must be checked for leaks before each use with water.
The vases are supplied without any floral decoration shown. The color, size and design are binding and cannot be complained about later.
Claims for damages, in particular from culpa in contrahendo, from positive breach of contract and from tort, are excluded both against ICONIC HOME and against vicarious agents or assistants used by ICONIC HOME , unless the damage was caused intentionally or through gross negligence. The limitation of liability does not apply to damages resulting from injury to life, limb or health.
The European Commission provides a platform for online dispute resolution (OS), which you can find under this link to the platform of the European Commission .
We are not obliged to participate in a dispute resolution procedure before a consumer arbitration board and do not participate in it.
§11 Anwendbares Recht
German law shall apply exclusively. This choice of law shall only apply to a consumer insofar as it does not restrict any mandatory statutory provisions of the state in which he has his domicile or habitual residence.
